Marcos’s abuses prompted the framers of the 1987 Constitution to check the president’s prerogative to declare martial rule.

Facebook page “BBM SARA Tv’s” video on July 31 erroneously claimed that the late dictator Ferdinand Marcos had to ask Congress to declare military rule in 1972.

The wrong claim was contained in the video caption: “MARTIAL LAW bakit nga ba hiniling ng ating dating Pangulo sa kaniyang legislatura na mag declare ng Martial law o batas militar..itoy upang mapigilan ang kaguluhan at ang pag dami ng mga makakaliwang grupo..”

Marcos, however, did not need congressional concurrence to declare military rule under his Proclamation 1081.

The 1935 Constitution provided Marcos the legal basis to “place the entire country under Martial Law” on his own.

He then proceeded to suspend the charter and padlock the Senate and House of Representatives.

Opposition politicians and critics were rounded up and jailed.

Marcos’s abuses prompted the framers of the 1987 Constitution to check the president’s prerogative to declare martial rule.

The new constitution prohibited the suspension of the constitution and courts. The 1987 charter also allowed Congress to revoke a martial law proclamation and the Supreme Court to review it.

The error-laden video by BBM SARA Tv’s has been viewed more than 700 times.
