Ang iba’t ibang post na kumakalat sa social media ay nagsasabing bawal ang pagpapalabas ng mga survey bago ang eleksyon sa ilalim ng Seksyon 5.4 ng Republic Act (RA) 9006 o ang Fair Election Act.
Ayon sa batas:
“Surveys affecting national candidates shall not be published fifteen (15) days before an election and surveys affecting local candidates shall not be published seven (7) days before an election.”
Sinasabi rin ng mga post sa social media na ang mga survey firm tulad ng Pulse Asia ay maaaring managot sa paglabag sa probisyong ito ng batas.
Ito ay MALI.
Ang Korte Suprema ay nagpasya noong Mayo 2001 na ang seksyon 5.4 ng RA 9006 ay labag sa konstitusyon dahil (1) ito ay nagpapataw ng prior restraint sa kalayaan sa pagpapahayag, (2) ito ay isang direkta at kabuuang pagsupil sa isang kategorya ng pagpapahayag kahit na ang gayong pagsupil ay para lamang sa isang limitadong panahon, at (3) ang interes ng pamahalaan na hinahangad na isulong ay maaaring makamit sa pamamagitan ng iba pang paraan maliban sa pagsugpo sa kalayaan sa pagpapahayag.
Dahil dito, legal maglabas ng survey kahit ilang araw na lamang bago ang halalan.
