CLAIM: The International Criminal Court has junked the Marcos administration’s appeal to probe former president Rodrigo Duterte.

A photo posted on TikTok falsely claimed that the International Criminal Court had dropped the case against former president Rodrigo Duterte for his deadly war on drugs.
The overlay text also falsely claimed that the Marcos administration had filed another appeal to let the ICC investigate the violations of human rights and extrajudicial killings by the previous administration.
The erroneous text read: “Binasura na ng ICC ang kasong EJK sa mga [Duterte.] Congress, [BBM, and DOJ nag-file] ulit sa ICC [para paimbestigahan] ulit [ang ‘war on drugs ng dating Pangulong Duterte].”
(“The ICC junked the EJK cases against the Duterte family. Congress, BBM, and DOJ have filed another appeal before the ICC to investigate the ‘war on drugs’ of former president Duterte.”)
User @alongbagsik cited Rappler’s original “The wRap” report dated July 18, 2023 out of context.
The report in fact said the ICC had junked the appeal of the Marcos government to stop the probe into drug war-related killings.
The ICC expressed a commitment to resume its investigation into drug war-related killings under the Duterte administration.
ICC Presiding Judge Marc Perrin de Brichambaut said in 2023, “The chamber was not satisfied that the Philippine government is not making a real and genuine effort to carry out the investigations and prosecutions” to Duterte’s “war on drugs.”
The Philippines still remains marked as “ongoing” on the ICC’s situations under investigation list, among 12 others.
